The Tariff Has a Long Commute

Tariffs are often sold as a clean border event: government raises a wall, foreign producer pays, domestic factory hums, voter applauds. In practice, they are a scheduling problem spread across customs brokers, purchase orders, inventories, contracts and eventually the shelf label. The delay is politically convenient. A tariff can be announced at podium speed and arrive in household budgets at container speed.

The larger problem is that the institution meant to make those costs predictable is operating with its legal circuitry partly removed. The WTO’s appellate body has lacked the necessary quorum since late 2020, after the United States blocked appointments. A ruling without a functioning final appeal stage is rather like a traffic code enforced by an appeals court that has gone on an extended spiritual retreat.

That does not mean trade rules have vanished. The same account puts 72% of world trade under WTO rules. It means rules increasingly compete with unilateral tariffs, retaliatory measures and national-security claims—precisely the conditions in which importers must price not only a product but the odds that its route, classification or duty rate changes halfway through the buying season. Consumers do not receive an invoice titled geopolitical uncertainty. They receive one labeled groceries, appliances, clothing or equipment.

The WTO’s difficulties did not begin with any single administration, and pretending otherwise is the sort of historical housekeeping that leaves the leak untouched. The organization inherited consensus decision-making, expanded into services, agriculture and intellectual property, then welcomed a membership in which developing countries comprise roughly three-quarters. Any member can block an outcome; the resulting diplomacy has the briskness of a committee trying to agree on lunch during a fire.

China’s 2001 accession exposed a particularly costly mismatch. According to Keith Rockwell’s history of the institution, the system struggled with an economy combining state support and export-oriented production. Disputes over subsidies, state-owned enterprises and anti-dumping rules then turned technical definitions into industrial policy by other means. Firms sourcing steel, components or finished goods cannot wait for philosophical agreement on what counts as a public body; they must decide whether to order, reroute, absorb or pass through the cost.

National-security tariffs make this even less tidy. Nine WTO members successfully challenged the first Trump administration’s steel and aluminum measures, but the legal exception remains contested and Washington continues to assert broad discretion. Earlier US duties were 25% on steel and 10% on aluminum, the article notes. The point is not that every tariff is economically identical. It is that an increasingly elastic security rationale turns trade compliance into contingency planning—and contingency planning is a cost center with excellent posture and no loyalty points.

For businesses, the relevant question is not whether tariffs are good or bad in the abstract, a debate that has consumed enough panel discussion to heat a small republic. It is who has the bargaining power when costs arrive. Large retailers may renegotiate with suppliers, change sourcing, draw down inventory or accept thinner margins temporarily. Smaller importers usually enjoy fewer of those options and more urgent conversations with lenders.

The surrounding investment climate shows why supply-chain uncertainty is not merely a checkout-line story. In an ETMarkets interview, Edelweiss Life Insurance CIO Ritesh Taksali argued that geopolitical uncertainty, wars and unclear demand, supply-chain and input-cost conditions had slowed private capital expenditure. He also said companies had maintained margins amid higher raw-material and logistics costs partly through price increases, cost rationalisation and efficiencies. That is the transmission mechanism in miniature: a cost shock is not simply paid; it is allocated.

There is a tempting sequel in which capital seeks more diversified manufacturing and consumption markets, investment arrives, capacity expands and resilience becomes profitable. That is possible, not automatic. Taksali’s case for an Indian capex revival is explicitly conditional on better visibility, even as he sees domestic advantages in infrastructure, incentives and diversified growth. The useful consumer lesson is correspondingly unglamorous: tariffs matter most not on announcement day but at the moments firms revise contracts, defer factories, alter suppliers and decide which costs can safely be handed onward. Trade policy is retail policy with a longer fuse.
